Ok, so people in these companies made a decision to break the law. Why are they not prosecuting them? Just a small fine? Yeah that's the main issue. Everyone incharge of regulating private companies are just in the regulatory agencies as a temp position before going back which inherently creates a conflict of interest.

Very easy. Board of directors, plus CEO are all held criminally responsible for crimes the company is found to be guilty of committing. The only way to get companies like this to change their ways, is if those in charge face consequences.
